In the past few months, I’ve had several clients come to me to evict a tenant from an illegally converted garage unit. For whatever reason, the landlord decided to convert their garage into a home by installing a bathroom, kitchen, and other items. The landlord then rents out the garage unit to a tenant. Unfortunately, a lot of the time, the landlord failed to secure the necessary certificate of occupancy and did not register the unit with rent control (if required). This leads to an illegal garage rental unit situation.
My office has successfully evicted tenants from illegal garage units throughout southern California. Any agreement to rent an illegal garage unit is void and the tenant must leave. However, the landlord may be required to pay relocation costs to the tenant depending on the circumstances, and the landlord may face a citation/fine from government agencies since the landlord rented out the garage unit illegally.
