Prohibiting Smoking in California Rental Units

California landlords of residential units may prohibit smoking on the property.  Leases or rental agreements entered on or after January 1, 2012 that prohibit smoking shall include a provision specifying the areas where smoking is prohibited.

For leases entered into before January 1, 2012, a California landlord wishing to prohibit smoking must provide proper notice to the California tenant that outlines the smoking prohibition in the California rental unit.
