What happens if your tenant moves out of the property and possession is no longer an issue, after you’ve already begun the eviction (unlawful detainer) process?
Typically, you’re still able to continue your lawsuit against the tenant even if the tenant has moved out and possession is no longer an issue. If the tenant breached the contract and owes you money, you may be able to convert your case to a regular civil action that is not governed by the unlawful detainer laws.
