My firm handles many evictions throughout southern California. One of the biggest tenant defenses that I see, even though many of them have no merit, is the defense of the warranty of habitability.
A warranty of habitability is implied in all residential rental agreements, and it cannot be waived in writing or orally. The tenant has a nonwaivable right to live in a habitable unit.
However, the tenant has the duty and obligation to repair damages that they cause.
